1. Heard Mr. M. Islam, learned counsel for the applicant and Ms. N. Borah, learned counsel for the opposite parties/respondents.

2. The present Interlocutory Application is filed for impleadment of Smt. Keerthi Jalli, IAS, Commissioner to the Government of Assam in the Department of Panchayat and Rural Development (P&RD) Department as the opposite party/contemnor No. 3 in the connected contempt petition being Cont. Cas(c) No. 753/2023.

3. Perused the averments made in the application as well as the communication dated 19.02.2026.

4. By the aforenoted communication dated 19.02.2026, the order dated 09.12.2022, passed in WP(C) No. 7162/2022, was brought to the notice of the present Commissioner, P&RD Department. The direction issued in order dated 09.12.2022 was that the concerned Commissioner shall complete his/her

exercise within a period of one month from the date of receipt of certified copy of the aforesaid order.

5. In view of the aforesaid, this Court is of the opinion that this Interlocutory Application does not have any cause of action till 19.03.2026, on which date, one month of knowledge of the proposed contemnor shall be over.

6. In view of the aforesaid, Mr. Islam, learned counsel for the applicant submits that he may be allowed to withdraw the present Interlocutory Application with a liberty to file an appropriate application when it matures.

7. Accordingly, the present Interlocutory Application stands closed.
