Heard Mr. A. Bhattacharyya, learned counsel for the applicant/Insurance Company.

This Court vide order dated 18.05.2026 observed that notice on respondent Nos.1 and 3 was complete. However, the learned counsel for the applicant submitted that the presence of the respondent No.2 might not be necessary for adjudication of the connected appeal and, therefore, he prayed for waiver of notice in respect of the respondent No.2.

Today, when the matter is called out, none appears for the respondent Nos.1 and 3.

The instant application has been filed praying for condoning the delay of 65 days in filing the connected appeal against the judgment and award dated 18.08.2025 passed by the learned Member, MACT, Sonitpur, Tezpur in MAC Case No.91/2023 (D).

The reasons for the delay have been set out in paragraphs 3 to 5 of the application.

I have perused the same and found that sufficient cause has been shown by the applicant to explain the delay in filing the appeal.

Accordingly, the delay is condoned.

This interlocutory application stands disposed of.
