The instant application is filed by the applicant praying for the suspension of the impugned judgment and award dated 27.09.2018, passed by the learned Member, MACT No. 3, Kamrup (M), Guwahti in MAC Case No.1211/2015.

Heard the learned counsel for the applicant and also heard the learned counsel for the respondents nos 2, 3 and 5.

The learned counsel for the applicant submits that the applicant has already preferred an appeal against the impugned judgment and award dated 27.09.2018, passed by the learned Member, MACT No. 3, Kamrup (M), Guwahati in MAC Case No.1211/2015 and the said appeal is admitted by this Court. In the event that the impugned judgment is not suspended during the pendency of the appeal, the applicant will suffer irreparable loss and injury to the applicant.

In view of the circumstances stated above, the impugned judgment and award dated 27.09.2018, passed by the learned Member, MACT No. 3, Kamrup (M), Guwahati in MAC Case No.1211/2015 shall remain suspended till the disposal of the connected appeal subject to the condition that the applicant shall deposit 50% of the awarded amount before the Registry of this Court within 6
