Heard Mr. K Das, Learned Counsel for the Applicant. Also heard Mr. Y N Mahanta, Learned Counsel for the Opposite Party No. 1 and Mr. A K Bhuyan, Learned Senior Counsel assisted by Mr. A Talukdar, appearing for the Opposite Party Nos. 3 & 4.

The present Interlocutory Application has been instituted by the State Bank of India, who is the Respondent No. 2 in the connected Writ Petition being WP(C) No. 3123/2026, praying for deletion of its name from the array of the Respondents. It is contended by the Applicant that the School in question, is neither owned nor managed by the State Bank of India and the Opposite Party No. 3/School, is an independent body managed by its Governing Body. It is further

projected that the applicant has got no say in the functioning of the said School, nor is involved in the day to day management of the same.

In view of the above position, the present Interlocutory Application has been instituted praying for deletion of the name of the Applicant from the array of the Respondents in the connected Writ Petition being WP(C) No. 3123/2026.

Mr. Y N Mahanta, Learned Counsel for the Opposite Party No. 1 and Mr. A K Bhuyan, Learned Senior Counsel appearing for the Opposite Party Nos. 3 & 4, submit that the applicant, herein, is neither a necessary nor a proper party in the proceedings of the connected Writ Petition being WP(C) No. 3123/2026 and accordingly, the prayer of the Applicant for deletion of its name from the array of the Respondents, in the connected Writ Petition, may be accepted.

I have heard the Learned Counsel for the Parties and perused the materials available on record.

In view of the submissions of the Learned Counsel for the Applicant and the projection made that the Applicant, herein, is in no way connected with the management of the Opposite Party No. 3/School in any manner; the said position not being disputed by the Opposite Party No. 1 or the Opposite Party Nos. 3 & 4, this Court is of the

considered view that the name of the applicant, herein, is to be permitted to be deleted from the array of Respondents in WP(C) No. 3123/2026.

Accordingly, the name of the Applicant, herein, stands deleted from the array of Respondents in WP(C) No. 3123/2026.

In view of the deletion of the name of the Respondent No. 2, the Petitioner to file an amended cause title in the connected Writ Petition

being WP(C) No. 3123/2026, by re-numbering the Respondents, now available on record. The amended cause title be filed within a period

of 2 (two) working days from today.

The Registry to incorporate the corrections in the CIS after the filing of the amended cause title.

With the above observations and directions, the present Interlocutory Application stands disposed of.
