The present application has been filed by the applicant/ claimant praying for release of 50% of the awarded amount to be deposited by the appellant in favour of the applicant/respondent No. 1.

Heard learned counsel Mr. I.A. Talukdar for the applicant/ claimant.

The applicant herein submits that the applicant is in dire need of medical treatment and also in need of finances for his family needs as well as for his medication and as he had borrowed a huge amount of money during his treatment, he is in need of the awarded amount.

Accordingly, it is prayed that the 50% of the awarded amount may be released to the applicant.

This court in IA (C) 2411/2026 has already directed the appellant/ insurance company to deposit 50% of the awarded amount within six weeks from today before the Registry of this court.

Accordingly, upon deposit of the same, the Registry shall allow the applicant/claimant to withdraw the said deposited amount upon proper verification and identification subject to execution of an indemnity bond of equivalent amount.
