1. Heard Mr. A Bhattacharyya, the learned counsel for the applicant.

2. On perusal of the office note dated 31.08.2026, it appears that notice issued to the OPs by speed post have been duly served. Today, no one represented the OPs.

3. As such, this court is inclined to proceed ex-parte against the OPs in this IA.

4. This is an application filed under Section 5 of the Limitation Act for condonation of delay of 83 days in preferring the connected appeal.

5. The learned counsel for the applicant has submitted that the applicant has stated the reasons for delay in paragraph 3 to 5 of the present IA.

¶32

6. After going through the grounds stated in the said paragraph, this court is of the considered opinion that the delay of 83 days in preferring the connected appeal has been sufficiently explained. As such, the said delay is hereby condoned and this IA is accordingly, allowed.

¶33

7. Registry is directed to register the connected MAC App and list the same for admission after a week on a date to be fixed by the Registry.
