Heard Mr. A. Mannaf, learned counsel appearing for the applicant. Also heard Mr. N. R. Sharma, learned Standing Counsel, BTC for proposed respondent No. 3.

By way of this application, the applicant seeks impleadment of the new incumbent, namely, Mr. Mukesh Chandra Sahu, Principal Secretary, Bodoland Territorial Council (BTC), Kokrajhar, in terms of the order dated 06.05.2026 passed by this Court in the connected Cont.Cas(C) No. 46/2023.

It appears that the applicant had filed the aforesaid contempt petition alleging willful and deliberate violation of the order dated 17.12.2021 passed by this Court in WP(C) No. 6130/2021.

It further appears that when the contempt petition was taken up on 06.05.2026, a submission was made before this Court that the then contemnor No. 3, namely, Shri. Akash Deep, was no longer discharging the function as Principal Secretary, Bodoland Territorial Council, Kokrajahr. In view thereof, this Court allowed the applicant to implead the newly appointed incumbent, namely, Mr. Mukesh Chandra Sahu, who is presently holding the post of Principal Secretary, Bodoland Territorial Council. Accordingly, the present application has been filed.

Mr. N. R. Sharma, learned counsel appearing for the proposed contemnor/respondent No. 3, submits that he has no objection to the impleadment of Mr. Mukesh Chandra Sahu as contemnor No. 3 in the connected contempt petition.

I have given my prudent consideration to the submission made by the learned counsel appearing for the parties and have perused the material available on record.

Having regard to the fact and circumstances of the case, this Court is of the view that, for the effective adjudication of the connected contempt petition, the present incumbent holding the post of Principal Secretary, Bodoland Territorial Council, is required to be impleaded.

Accordingly, the prayer made in this application stands allowed.

Mr. Mukesh Chandra Sahu, Principal Secretary, Bodoland Territorial Council, Kokrajhar, stands impleaded as contemnor No. 3 in Cont.Cas(C) No. 46/2023.

Let an amended cause-title be submitted before the Registry for doing the needful.

The interlocutory application accordingly stands disposed of.
