Heard Mr. R.C. Paul, learned counsel for the applicant. Also heard Mr. A.U. Ahmed, learned counsel for the claimant/ respondent.

The instant application under Order 41 Rule 5 read with Section 151 of the CPC has been filed by the applicants for stay of the impugned judgment and award dated 16.02.2026, passed by the learned Member, MACT No.1, Kamrup (M), Guwahati in MAC Case No. 361/2017.

The learned counsel for the applicant/ appellant has submitted he has already filed MAC Appeal before this Court against the impugned judgment and award dated 16.02.2026, which has been admitted by this Court.

The learned counsel submits that if the impugned judgment and award dated 16.02.2026 is not suspended during the pendency of the MAC appeal, irreparable loss will be caused to the applicant. The learned counsel further submits that he will deposit an amount of Rs. 70,000/- before the Registry of the Court which may be allowed to be withdrawn by the claimant/ respondent no.1

In vew of the above facts and circumstances, the instant application is allowed and the instant impugned judgment and award dated 16.02.2026, passed by the learned Member, MACT No.1, Kamrup (M), Guwahati in MAC Case No. 361/2017 is stayed till the disposal of the connected MAC appeal, on the condition that the applicant shall deposit Rs. 70,000/- before the Registry of this Court within 4 weeks from today. Upon receipt of such deposit, the Registry shall allow the claimant/ respondent no.1 to withdraw the same amount upon

proper identification and verification and upon execution of indemnity bond.
