Heard Mr. L.R. Mazumdar, learned Counsel for the petitioner and Mr. M.P. Goswami, learned Additional Public Prosecutor for the State.

By this application, the petitioner has sought for bail in connection with Lakhipur P.S. Case No. 140 of 2025 corresponding to GR Case No.188/2025 registered under Section 21(b)/29 of the NDPS Act. The facts as narrated in the

First Information Report dated 30.10.2025 reveals that on an information from a reliable source that some persons loitering at a particular area and were supposed to deal with NDPS dealings, the police personnel after complying with the necessary requirements reached that particular area and on laying the naka checking and found those persons and detained them and the petitioner being one of them and on search being made, a blue coloured bag was recovered from the co-accused wherein 15 Nos. of plastic soap case was recovered and on opening the soap case heroine was recovered from him. Nothing was recovered from the petitioner but the petitioner was found in the company of the other coaccused from whom heroine was recovered.

Mr. L.R. Mazumdar, learned Counsel for the petitioner states that as far as the petitioner is concerned nothing was recovered from him. However, on completion of the investigation, charge sheet was submitted. Moreover, the petitioner is inside the jail for 132 days.

On the other hand, Mr. M.P. Goswami, learned Additional Public Prosecutor for the State submits that all the three accused persons were together and the contrabands were recovered from the joint possession of the same and on finding the case against the petitioner, charge sheet was submitted.

On consideration of the submissions made by the counsel for both the parties, this Court deems it fit that the petitioner be released on bail of furnishing bail bond of Rs. 30,000/- in NDPS Case No.01/2026 with one local surety of the like amount to the satisfaction of the Special Judge, Cachar under the following conditions:

i) The petitioner will appear before the Trial Court as

and when call for.
