Heard Mr. S. Hussain, the learned counsel for the petitioner and Mr. B. Sarma, the learned Addl. Public Prosecutor for the State of Assam.

By this application, the petitioners have prayed for bail in connection with PRC Case No.983/2026 arising out of Nagaon Police Station Case No. 28/2026, under Sections 310(2)/311 of BNS, 2023.

The FIR in connection with which the petitioners were shown arrested was lodged 09.01.2026, by one, Shehnez Parbin Sultana, stating inter alia that 08.01.2026, at around 7.30 p.m. some persons came to her house seeking donation and when her husband opened the door, the said persons placed pistol on his head and by tying his hands took him to upstairs and the said persons snatched the gold chain, bangles and other ornaments by gagging the mouth of the informant. It is further stated that, the said persons had assaulted both the informant and her husband and had tied up the 6 year old son and kept her daughters at the point of the pistol. It is further stated that, the informant was badly injured and that, the persons left the place after snatching the valuable articles by closing the door from outside and it is the neighbours who had opened the door and saved the informant.

Learned counsel for the petitioner submits that, the petitioners were already arrested in connection with an earlier case and they were shown arrested in connection with the present case. He submits that there is violation of Sections 47 and 48 of the BNS 2023 and has prayed for bail.

Mr. B. Sarma, the learned APP, for the State, has placed the charge-sheet and has shown that TIP was conducted and the informant had identified both the petitioners in the same. He also submits that the injury on the informant is very serious.

Upon consideration of the submissions made by the learned counsels, more so in view of the fact, that the petitioners were already implicated in another case and they were identified by the informant and also due to the fact that notice under Sections 47 and 48 were given to the petitioners, this court does not deem it fit to enlarge the petitioners on bail at this stage.

Petition is dismissed.
