2 . This is an application under Section 483 of BNSS, 2023 praying for regular bail to the petitioner namely Anowar Hussain, who was arrested on 26.07.2026 in connection with Baihata Chariali P.S. Case No. 166/2026

registered under Sections 303(2)/ 317(2)/ 3(5) of the BNS, 2023, read with Sections 13(1) of Assam Cattle Preservation Act, 2021 and read with Sections 11(1)(a)/ 11(1)(d) of the Prevention of Cruelty to Animal Act, 1960.

3 . The allegation against the petitioner is that the petitioner was a driver of the vehicle which was intercepted by the police and 25 numbers of cattle were recovered from the said vehicle. The petitioner was apprehended while trying to flee.

4 . The learned counsel for the petitioner submits that the petitioner has spent 53 days behind the bars.

5 . The case dairy as called for has been received and perused.

6 . Having regard to the nature of the allegation and the period of detention of 53 days in custody, the prayer for bail is allowed

Accordingly, it is directed that the petitioner named above shall be released on bail on furnishing a bail bond of Rs. 50,000/- with two securities of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Rangia, Kamrup in connection with the aforementioned case. It is provided that the petitioner shall appear before the I.O. for further investigation as and when called by the IO and shall not try to tamper with the evidence or hamper the investigation of the case in any manner and shall not intimidate to any persons acquainted with the facts of the case.
