Heard Mr. J. S. Ahmed, learned counsel appearing for the accused applicant and Mr. M. P. Goswami, learned Addl. PP for the State of Assam.
2. This is an application under Section 483 of the BNSS, 2023 praying for granting bail to the accused applicant in connection with Dalgaon P.S. Case

No. 116/2026 under Section 351(2)/64 (1)/78 of BNS, 2023.

An FIR was lodged on 01.08.2026 before the Officer-in-charge of Dalgaon Police Station by the informant alleging inter alia that while she was waiting for a bus, the accused applicant came with a car and asked her whether she would like to be dropped in her place. When the informant went inside the vehicle and after proceeding for some time, the accused applicant showed the informant certain photographs and videos in his mobile phone wherein she could see that the accused applicant has stealthily taken some naked photographs and nude videos of the informant.
4. The accused applicant, thereafter, threatened her that if she does not consent for having some sexual intercourse with the accused applicant, then the photographs and videos will be made public. On such threatening, the informant consented to have sexual intercourse with the accused applicant and then they had a physical relationship in a hotel later on.
5. On the basis of the FIR, Police registered Dalgaon P.S. Case No. 116/2026 under the aforementioned sections.
6. On an earlier occasion, the anticipatory bail preferred by the accused applicant vide AB No. 1855/2026 was rejected by this Court on 20.08.2026.
7. The Case Diary in the instant case has been received and the same is being perused.
8. The accused applicant has surrendered himself and was arrested on 21.08.2026 and since then he is behind the bar.

The learned counsel for the accused applicant has referred to certain photographs annexed in the instant bail application, wherein, the accused applicant and the informant could be seen together happily in a room which looks like a hotel. It is also seen that the informant is a major girl of 23 years old.

Taking into account the fact that the accused applicant has surrendered himself and is cooperating with the investigation and he is behind the bar for the last 20 days, this Court is of the considered opinion that the accused applicant should be granted bail. Accordingly, it is directed that the accused applicant, namely, Suhrab Ali be released on bail on furnishing a bail bond of Rs.30,000/- with a surety of like nature to the satisfaction of the learned CJM, Darrang, Mangaldoi subject to the condition that:
(i) that the accused applicant shall cooperate with the investigation and shall make himself available as and when called for by the Investigating Officer .
In terms of the above, this Bail Application stands disposed of, as allowed.
