2 . The case is today fixed for hearing on the question of maintainability under Section 483 of the BNSS, 2023 in view of provision of Section 21 of the NI Act.

3 . The learned counsel for the petitioner has submitted that in view of the order dated 05.12.2025, passed by a coordinate Bench of this Court in Mamunur Rashid- Vs. State of Assam in BA No. 1727/2025 , the present petition may not be maintainable and accordingly, prays for withdrawal of the same to move the appropriate forum with an appropriate application.
