This is an application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 whereby the petitioners, 1. Sri Bappi Chandra Das & 2. Md. Inamul Haque, have prayed for granting them bail after they were arrested in connection with Khetri P.S. Case No.94/2026 under Sections 303(2)/317(2) BNS, 2023, R/W Section 11(1)(a)(d)(e)(h) of Prevention of Cruelty to Animal Act, 1960 R/W Section 13(1) of the Assam Cattle Preservation Act, 2021.

As per the FIR, the truck being driven by the petitioner No.1, of which the petitioner No.2 is the owner was intercepted along with 32 nos. of cattle suspected to be stolen.

The petitioner No.1 was arrested on 20.08.2026 and the petitioner No.2 was arrested on 23.08.2026.

It appears from the order dated 05.09.2026 passed by the learned Additional Chief Judicial Magistrate, Kamrup(M), in Khetri P.S. Case No.94/2026 that the custody of the cattle has been handed over to its owner upon verification of the valid documents relating to purchase of the said cattle thereby, indicating prima facie that the cattle were not stolen goods.

Having regard to the above as well as the period of detention, the prayer for bail is allowed.

Accordingly, the petitioner named above shall be released on bail on furnishing a bail bond of Rs. 50,000/- each, with one surety, each of the like amount, to the satisfaction of learned jurisdictional Magistrate/Court. Bail application stands disposed of.
