Heard Mr. A.K. Azad, learned counsel for the petitioners and also heard Mr. P. Borthakur, learned Addl. P.P. for the State.

In this petition under Section 483 BNSS, the accused-petitioners, namely, 1. Md. Maser Ali, 2. Sahed Ali, who were arrested on 14.12.2025 in connection with Gorchuk P.S. Case No. 340/2025 under Section 13(1) of the Assam cattle Preservation Act, 2021 R/W Section 11 of Preservation of Cruelty to Animals Act, 1960.

The allegation against the petitioner is that the petitioners beg to state the facts inter-alia that the on 14.12.2025 the police of Gorchuk PS has conducted raid in the house of the petitioner No.1 and found 85 kgs of beef meat along with Bothi, Dao, digital weighing machine and Rs.2,750/- in the possession of the petitioners and on being asked, the petitioner was unable to produce any valid documents regarding the slaughtering of the cattle and therefore seized the meat and also apprehended the accused persons.

It is submitted on behalf of the petitioners that petitioner had slaughtered his own domestic bull for religious purposes and the same was distributed among the family members and not intended for sell. The meat has been seized and disposed of pursuant to the orders passed by the learned Magistrate and sample sent for examination and in the meantime the petitioner has spent 25 days in custody.

Considering the nature of the allegations, further custodial detention of the petitioners may not be necessary.

Accordingly, the prayer for bail is allowed .

The accused-petitioners, 1. Md. Maser Ali, 2. Sahed Ali , shall be released on bail of Rs.20,000/-(Rupees Twenty Thousand) each with one surety each of like amount to the satisfaction of learned CJM, Kamrup (M) in connection with the aforesaid case.

It is further directed that the petitioners shall co-operate with the investigation.
