2. This is an application filed under Section 482 of the BNSS, 2023, praying for grant of pre-arrest bail to the accused-applicant in connection with Basugaon P.S. Case No. 06/2026, registered under Sections 308(5)/127(2)/61(2) of the BNS, 2023.

The prosecution’s case in brief is that on 23.04.2026, the informant, namely, Safiqul Islam, who has a Pharmacy at Basugaon, lodged an FIR alleging that on 15.05.2026, the accused-applicant called the informant to his house to discuss for treatment of a patient. When he reached the house of the accused-applicant at around 9.30 PM after closing the pharmacy, the accused-applicant showed him an unknown woman present at his house and told him that she required some treatment and thereafter, the accused-applicant left the room. After his leaving, some persons knocked on the door of the house and the woman who opened the door. On opening of the door, three persons entered the room and started threatening and beating the informant and forced him to sit with the woman and demanded money from him, telling him to confess his involvement in immoral activities with her. The three unknown persons claimed themselves to be NDFB members and threatened to kill him and his family. On the next date, the accusedapplicant had to pay an amount of Rs. 2,30,000/- in cash to the accused person in presence of Amir Hussain Mondal.

4. The learned counsel appearing for the accused-applicant submits that the accused-applicant in the instant case is not named in the FIR as an accused. However, his name was mentioned as a person who was present while the alleged money was delivered to the accused-persons by the informant. He submits that since his name has been mentioned in the FIR though not as an accused, the police is searching for him and police has visited his residence several times. He submits that in view of the aforesaid, he has serious apprehension that he may be arrested in connection with the instant case and therefore, prays for pre-arrest bail.

5. Case Diary in the instant case has been received and the same is perused by this Court.

6. The learned Addl. P.P., submits that there are sufficient incriminating materials about the involvement of the accused-applicant in the instant case. He further submits that sufficient materials have been gathered by the Investigating Officer, regarding involvement of the accused-applicant in other cases, wherein also similar modus operandi has been adopted by the accused-applicant to extract money from the innocent victims. Therefore, he prays for rejection of the bail at this stage.

7. This Court has heard the submissions made by the counsel appearing for the respective parties as well as has gone through the Case Diary.

8. On perusal of the Case Diary and having found sufficient prima facie materials against the accused-applicant, this Court is not inclined to grant any relief to the accused-applicant at this stage.

9. Accordingly, the instant anticipatory bail application is disposed of as rejected.
