Heard Mr. S. Islam, learned Counsel for the petitioners and Mr. B. Sharma, learned Additional Public Prosecutor for the State.

By the last order dated 03.09.2026, instruction was sought for from the learned Additional Public Prosecutor as to whether charge sheet was submitted in respect of the present petitioners or whether they are discharged from the said complaint.

Today when the matter is called up, the learned Additional Public Prosecutor had place an instruction received from the police personnel from Barpeta Police Station, wherein it was stated that charge sheet is submitted vide charge sheet no. 244/2026 on 24.08.2026 only in respect of accused person namely Manowar Hussain. It was further informed that with regard to other persons namely Muktar Ali, Afjal Hussain @ Afjalur Haque and Amina Begum, no charge sheet is submitted against them and that they have not been charge sheeted. It be stated here that three persons who were not charge sheeted in connection with the present case are the petitioners in the present petition.

As such, the learned Counsel for the petitioner submits that in view of the order of discharge made by the Investigating Officer, the instant bail application be closed.

Prayer is allowed.

Accordingly, the Anticipatory Bail Application is closed.

Further the interim order giving interim protection to the said petitioners on 27.08.2026 also stands vacated.
