Heard Mr. S. N. Nath, learned counsel for the petitioner. Also heard Mr. M. P. Goswami, learned Additional Public Prosecutor.

This petition under Section 482 BNSS is filed by the petitioner, namely, Samin Shah , apprehending arrest in connection with Azara P.S. Case No. 35/2026 registered u/s 126(2)/117(2)/351(2)/109 of BNS.

The case was registered based on an FIR dated 1/4/2026 alleging assault upon the informant by the accused petitioner, resulting in injuries including serious eye injuries.

The learned counsel submits that as per the information, the case has been charge sheeted.

In view of the completion of investigation, this anticipatory bail application is disposed with the observation that the petitioner is at liberty to appear before the learned trial court and seek regular bail, whereupon necessary orders may be passed also keeping in mind the stage of the case of the petitioner if the charge sheet involves any sections punishable with life or death.

The petitioner is also at liberty to directly appear before the Sessions Court invoking Section 483 BNSS and seek regular bail in terms of the principles laid down in the case of Pranab Rauth vs State of Assam 2008 SCC Online Gau 226: (2008); State of Assam, in re, 2006 SCC OnLine Gau 104: (2007) 2 Gau LR 182 and Samsuddin vs State of Assam, 2014 SCC OnLine Gau 422: (2014) 5 Gau LR 193.

Accordingly, the bail petition stands disposed of.
