Heard Mr. HR Ahmed, learned counsel for the petitioner and Ms. S. Baruah, learned CGC.

2] This writ petition has been filed by the petitioners, being aggrieved by the non-declaration of their results, in response to the advertisement dated 27.10.2022 for the recruitment of Constable (GD) in the Central Armed Police Forces (CAPFs), SSF, Rifleman (GD) in the Assam Rifles, and Sepoy in the Narcotics Control Bureau under the Examination, 2022, for which they had applied and participated in the selection process. The petitioner had successfully completed the computer based examination, physical standard test and physical efficiency test and medical examination. The results were declared by the Commission on 20.08.2023 but the results of the petitioners were kept withheld due to mismatch of Biometric Data of the writ petitioners. The petitioners are aggrieved that their cases have not been examined and results have not been declared while other similarly situated persons, who had declared selected in the results published on 20.08.2023, has already been appointed.

3] Pursuant to the notice being issued, the respondents have filed their affidavits-in-opposition and rejoinder affidavit has also been filed on behalf of the petitioners.

4] Today, when the matter was called, the learned CGC, on instructions, submitted that the results of petitioner No. 4 and petitioner no. 7 were verified, and after rectifying the errors/mismatches that had occurred, they have been appointed. The results in respect of petitioners no. 3, 5, and 6 were verified and found to be correct, and based on the verification report for revision of the results, the matter has been sent to the Headquarters. So far as the petitioners no.1 & 2 are concerned, the instructions with regard to their status is not available with the learned CGC.

5] Considering the fact that the process for revision has been undertaken against some of the petitioners, and the petitioners no.4 & 7 have already been appointed, this Court is of the view that the writ petition can be closed with a direction to the respondent authorities to expeditiously complete the process of verification and thereafter, if it is found that the petitioners were wrongly denied selection, appropriate orders shall be passed by the respondent authority with respect to the selection and appointment of the writ petitioners. Since the writ petitioners no.4 & 7 are already appointed, this order shall apply only in respect of the writ petitioner no.1, 2, 3, 5 & 6. The concerned respondents are accordingly directed to complete their verification and pass necessary order(s) after necessary rectification or revision, in respect of the writ petitioners no.1, 2, 3, 5 & 6, if they are found to be eligible for appointment in terms of the selection process.

Let this exercise be completed within a period of 90 (ninety) days from the date of receipt of a certified copy of this order.
