The petitioner had preferred this writ petition alleging inaction on the part of the Police in tracing out his daughter, who had gone missing since 14.08.2025.

The office of the Senior Superintendent of Police, Hojai vide Letter under Memo no. IV/HJI/Reader-WP[C]/2025/462 dated 03.12.2025, which is marked as Document – ‘X’ and kept with the case record, has provided instructions to the learned State Counsel that on the basis of the First Information Report [FIR] lodged by the petitioner, a case was registered on 20.11.2025 as Doboka Police Station Case no. 234/2025 under Section 87, Bharatiya Nyaya Sanhita [BNS], 2023 and investigation was initiated thereafter. During the course of investigation, it was revealed that the daughter of the petitioner, namely, Afsana Begum Talukdar, aged about 22 years, had been in a relationship with accused, Anjamul Hoque for the last two years and both of them had solemnized marriage. Upon completion of investigation, the case was returned in a final report vide Doboka Police Station Final Report no. 28/2025 dated 29.11.2025.

It is noticed that on 28.11.2025, the daughter of the petitioner was produced before

the Court of learned Judicial Magistrate, First Class, Hojai in connection with Doboka Police Station Case no. 234/2025 and the learned Magistrate heard the daughter of the petitioner as the victim after giving a reflection period. Thereafter, the statement of the daughter of the petitioner was recorded and was kept with the case record. As the daughter of the petitioner was found to be major, the Investigating Officer [I.O.] was directed to allow the daughter of the petitioner to go to a place of her own choice on execution of a personal bond of Rs. 3,000/- with condition that she would appear before the Court as and when required. The I.O. was also directed to ensure safe transportation of the daughter of the petitioner to the place of her choice. This Court has also perused the statement of the daughter of the petitioner recorded on 28.11.2025 by the learned Magistrate.

Having regard to the above fact situation obtaining in the case in hand, this Court does not consider it appropriate to proceed further with the writ petition as the daughter of the petitioner made her appearance before the Magistrate on 28.11.2025 and she has given her statement regarding her leaving of the parental house voluntarily. The writ petition is, accordingly, closed.
