Heard Mr. A. Chetry, learned counsel for the petitioner. Also heard Ms. G. Bora, learned standing counsel for the respondent No. 1 and Mr. N.J. Gogoi, learned standing counsel for the respondent Nos. 2 and 3.

2. Mr. Chetry, learned counsel for the petitioner submits that he has lost contact with the petitioner and as such, he has no up-to-date instruction in this matter.

At this stage, Mr. Gogoi, learned standing counsel for the respondent Nos. 2 and 3 has produced a letter of the Administrative Officer, Assam State Agricultural Marketing Board addressed to Senior Advocate, Gauhati High Court, dated 28.11.2017, and submits that the petitioner, Sri Dilip Kumar Das had been promoted to the post of Assistant Marketing Officer, vide No. ASAMB/Admn/996/Pt-II/2017-18/12, dated 14.07.2017, considering his

reservation quota. Mr. Gogoi further submits that as per his instruction, the petitioner retired on 31.03.2022, and as such, Mr. Gogoi submits that the prayer made in this petition has already been complied with and this matter becomes infructuous, and as such, the same may be closed.

4. Mr. Chetry, learned counsel for the petitioner submits that in view of the instruction so placed before this Court today and submitted by Mr. Gogoi, learned standing counsel for the respondent Nos. 2 and 3, this petition may be closed.

5. Having heard the submissions of learned counsel for both the parties, I have carefully gone through the petition and the documents placed on record, and also perused the letter dated 28.11.2017.

6. Perusal of the letter dated 28.11.2017, indicates that the petitioner, Sri Dilip Kumar Das had been promoted to the post of Assistant Marketing Officer, vide No. ASAMB/Admn/996/Pt-II/2017-18/12, dated 14.07.2017, considering his reservation quota, and the petitioner retired on 31.03.2022 from the said post, and that being so, the prayer made in this petition has already been complied with and as such, this matter becomes infructuous. Accordingly, this writ petition stands closed.
