Heard Mr. B. Hasurkar and Mr. A. Das, learned counsels, appearing for the petitioner. Also heard Mr. A. B. Dey, learned counsel representing the Indian Institute of Technology(IIT), Guwahati.

2. The present writ petition was instituted by the petitioner presenting a challenge to a tender notice dated 24.06.2025, inviting bids for installation of 4 nos. of lifts with capacity of 8 passengers at one time, at various sites of the IIT, Guwahati, campus.

3. The grievance of the petitioner was that the said tender was so issued by limiting the invitation of bids to certain brands selected for the purpose. The petitioner contends that the selection of brands would not be permissible to be made and the tender notice ought to have been so issued by only specifying the technical specification mandated for the purpose.

4. This Court vide order dated 22.08.2025, while issuing notice in the matter had directed the IIT authorities to extend the date of submission of the bid. The said order continues to hold the field.

5. On the last date of listing i.e. on 26.08.2025, the IIT authorities had placed before this Court, the report of the technical committee constituted in the matter. This Court had on perusal of the said, found certain inconsistencies and the same was required to be clarified by the IIT authorities and the matter was listed today. Today when the matter is listed, Mr. A. B. Dey, learned counsel representing the Indian Institute of Technology(IIT) authorities has placed on record a communication dated

03.09.2025, received by him, wherein, the IIT authorities, have intimated him that the tender notice dated 24.06.2025, has been cancelled by the Institute, on account of certain technical reasons.

6. The NIT dated 24.06.2025, having been cancelled, this Court is of the considered view that no further live issue arises for consideration in the present Writ Petition. Accordingly, the Writ Petition would be mandated to be closed.

7. As the Writ Petition has been held to mandate no further consideration on account of the fact that the tender notice dated 24.06.2025, impugned in the present proceedings, has been cancelled, the contentions raised by the petitioner in the present writ petition shall remain open to be so raised by the petitioner, in the event, any such proceedings would be mandated to be instituted by it, in the future.

8. With the above observations, the present Writ Petition stands closed
