Heard Mr. B. Phukan, learned counsel for the petitioner; Mr. C.K.S. Baruah, learned CGC for the respondent no. 1; and Mr. R.K. Talukdar, learned Standing Counsel, Accountant General [A&E], Assam for the respondent nos. 2 & 3.

By this writ petition, the petitioner had, inter-alia, sought for a direction to the respondent authorities for his appointment on compassionate ground. It is projected that the father of the petitioner, who was an employee in the office of the Accountant General [A&E], Assam, died-in-harness on 03.03.2022.

Mr. Phukan, learned counsel for the respondent has submitted that in view of the provisions of the Administrative Tribunals Act, 1985, the petitioner would like to withdraw the instant writ petition in order to avail appropriate remedy before the jurisdictional Central Administrative Tribunal [CAT] as per the provisions of Administrative Tribunals Act, 1985.

The submission of Mr. Phukan has not been objected by the learned counsel for the respondents’ side.

In view of the above, the instant writ petition stands dismissed on withdrawal. Liberty, however, stands reserved to the petitioner to avail appropriate remedy as permissible under the law.
