Heard Ms. Valentina Laldinpuii, learned counsel for the petitioners who submits that the petitioners are working as Staff Nurse under the Police Department and the Mizoram Home Guards.

All the petitioners are now working as Ward Superintendent at Zoram Medical College, Falkawn. The petitioners’ counsel submits that in terms of the Office Memorandum dated 15.01.2010 issued by the Government of India, Ministry of Health & Family Welfare, additional increments can be given to the petitioners if they had already achieved additional qualifications at the time of entry to the service as Staff Nurse. She submits that the present case is covered by the decision of this Court in WP(C) No. 42/2024 (Lalhmingsangi Sailo & 52 Ors Vs. State of Mizoram & 3 Others) and as such, has prayed for a direction to be issued to the respondents, to examine and verify the claim of the petitioners herein and to grant them increments in terms of the OM dated 15.01.2010 and FR 27(10).

Ms. Caroline K. Lungawipuii, learned Government Advocate for the State respondents submits that she does not have any objection to the prayer made by the learned counsel for the petitioners.

In view of the consent of the parties, the respondent authorities are directed to examine the claim of the petitioners in light of FR 27(10), OM dated 15.01.2010 and the Order dated 08.08.2024 passed in WP(C) 42/2024 and take a decision as to whether the petitioners are entitled to the grant of additional increments. Thereafter, if the respondents find that the petitioners are entitled to the grant of additional increments, the same should be provided to them.

The entire process should be concluded within a period of three months, from the date of receipt of a certified copy of this order.

The writ petition is accordingly disposed of.
