Heard Mr. B M Choudhury, learned counsel for the petitioner in Crl. Pet. No. 813/2012 and Ms. M Begum, learned counsel for the petitioner in Crl. Pet. No. 784/2012. Also heard Ms. M Kumari, learned Standing counsel, CBI appearing in both the above noted criminal petitions.

The respondent CBI has filed an affidavit in the matter and therein have highlighted the fact that the petitioners in both the above noted criminal petitions, have during the pendency of the present proceeding passed on, on 11.12.2016 (petitioner in Crl. Pet. No. 784/2012) and 11.12.2014 (petitioner in Crl. Pet. No. 813/2012), respectively.

In view of the above, the learned Standing counsel, CBI has submitted that the present criminal petitions would stand abated.

The said submission is not opposed to by the learned counsel for the petitioners.

¶27

In view of the above development taking place in the matters, on the death of both the petitioners, occasioning during the pendency of the present proceedings, both the criminal petitions, being Crl. Pet. No. 784/2012 and Crl. Pet. No. 813/2012 stand closed on being abated.
