Heard Mr. Moa Jamir, learned counsel for the applicant, who submits that there is a delay of 1231 days in filing the appeal against the judgement convicting the applicant under section 4(2) of

the POCSO Act and sentencing him to undergo rigorous imprisonment for 20 years with a fine of Rs. 10,000/-, in default, rigorous imprisonment for 6 months.

Ms. Livika, learned APP, Nagaland, submits that she has got no objection to make if the delay is condoned.

On considering the grounds taken for the delay in filing the appeal and on considering the fact that the matter pertains to the personal liberty of an individual, we are of the view that delay should be condoned.

Accordingly, the delay of 1231 days in filing the appeal is condoned. IA stands disposed of.
