1. Heard Mr. M. S. Ali, learned counsel for the applicant. Also heard Mr. K. Baishya, learned Additional Public Prosecutor for the State of Assam.

2. This is an application filed under Section 397 of the Code of Criminal Procedure, 1973 praying for suspension of sentence and for releasing the applicant on bail.

3. The applicant was convicted under Section 325 of the Indian Penal Code by the learned Chief Judicial Magistrate, Baksa, Mushalpur in G.R. Case No.37/2018, the appeal was dismissed by the learned Appellate Court.

4. I have gone through the impugned Judgments.

5. It is hereby directed that the sentence imposed upon the applicant by the Judgment 20.12.2021 passed by the Court of learned Chief Judicial Magistrate, Baksa, Mushalpur in G.R. Case No.37/2018 as well as the Judgment dated 12.03.2024 passed by the learned Sessions Judge, Baksa, Mushalpur in Criminal Appeal No.02/2022 shall remain suspended till disposal of the connected appeal.

6. The applicant Sri. Loknath Rajbongshi is allowed to go on bail Rs.20,000/- with a surety of like amount to the satisfaction of the learned Additional Chief Judicial Magistrate, Baksa, Mushalpur.

7. With the aforesaid direction, the I.A. stands disposed of.
