Heard Shri AFNU Mollah, learned counsel for the petitioners. Also heard Ms. P. Thapa, learned counsel appearing for the respondent Nos. 1 & 3.

Shri Mollah, the learned counsel has submitted that the present petition has been instituted qua an order dated 26.09.2023 passed in the connected WP(C)/166/2022. In the said order there was a direction for undertaking a verification exercise of the petitioners so as to include their names in the list of beneficiaries in respect of Gaurnagar Gaon Panchayat in the district of Goalpara. The learned counsel has submitted that the aforesaid direction has not been complied with and accordingly the present petition has been instituted.

Ms. Thapa, the learned counsel for the respondents has however submitted that instructions have been received as per which, the order in question has been duly complied with.

By referring to the written instructions, a copy of which has been placed before this Court, the learned counsel has submitted that out of the 40 nos. of petitioners in the writ petition, 6 nos. were already enlisted in the Permanent

Wait List (PWL) of the PMAY-G under the concerned Gaon Panchayat and would be benefited as soon as the allotment is made.

It is also provided that 4 nos. of petitioners have been found to be ineligible for the benefit and remaining 29 nos. of petitioners would be enlisted in the PWL of the PMAY-G following the guidelines.

Considering the aforesaid instructions this Court is of the opinion that the order of this Court has been substantially complied with, except for one of the petitioners.

The petition is accordingly closed.

A copy of the written instructions dated 09.09.2024 is made part of the records.

¶48

The petitioners who have been held to be ineligible including the one who has been left out would be at liberty to challenge the aforesaid decision in an appropriate proceeding.
