Heard Mr. H. Baruah, learned counsel for the applicants also heard Mr. R. C. Paul, learned counsel for the respondent Nos. 1,2 & 3.

This interlocutory application under Order XXII Rule 4 (5) (b) of the Code of Civil Procedure is preferred by the applicants for setting aside the abatement of CRP No. 360/2015 on account of death of respondent No.4.

Mr. Baruah, learned counsel for the applicants submits that the respondent No.9, in the CRP No. 360/2015 died on 27.05.2007, and that the applicants came to know about the same on 25.04.2018, and therefore, the application for substitution could not be filed in time for which there is a requirement for setting aside the abatement as per provisions of Order XXII Rule 4 (5) (b) of the Code of Civil Procedure and therefore, it is contended to allow this petition.

On the other hand, Mr. Paul, learned counsel for the respondent Nos. 1,2 & 3 submits that he has no objection in the event of allowing this I.A for setting aside the abatement.

Taking note of the submission of learned counsel for both the parties and also considering the facts and circumstances on the record, this Court is inclined to allow this application and accordingly, the abatement stands set aside and quashed.

In terms of above, this I.A. stands closed.
