The application under Section 482 of BNSS, 2023, has been filed by the petitioner, namely, Rajdeep Dutta who is apprehending his arrest in connection with Dispur P. S. Case No. 0654/2025 under Sections 316(2)/318(4)/336(3) of BNS, 2023.

The allegation against the petitioner is that he was working as Deputy Manager, Finance & Accounts in the informant’s company and by misusing his position he transferred an amount of Rs.49,00,856/- to his family members and friends. It appears from Annexure-3 annexed to the petition that the petitioner has also confessed to the aforesaid acts and admitted to having transferred the said amount to his family members and friends, although under the wrong impression that the money was meant for needy persons, which explanation is hardly acceptable.

Given the clear implication of the petitioner in transferring such a huge amount of money, the present case cannot be considered to be a fit case for grant of pre-arrest bail. Accordingly the pre-arrest bail stands rejected.
