This application under Section 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 filed by the petitioner, namely Mokbul Hussain , apprehending arrest in connection with Golakganj P.S. Case No. 188/2025

(Corresponding to G.R. Case No. 1120/2025) registered under Sections 179/ 180 of BNS, 2023.

The case arose out of an ejahar dated 25.07.2025 alleging that the petitioner had given some money to the co-accused, Basschani Khatun and she returned the same to him and thereafter, when he was trying to purchase something from one customer service point, five of the currency notes were found to be fake and she was apprehended.

The learned counsel for the petitioner has submitted before this court that by an order dated 07.08.2025, passed by the learned Addl. Sessions Judge, Dhubri regular bail has been granted to the lady accused name above.

Case diary is received and perused.

Upon perusal of case diary, no such materials would be found as imputing any knowledge to the petitioner as regards the fact that 5 numbers of notes of Rs. 500/- denomination in the bundle of rupees ten thousand which he handed over to the co-accused were fake notes.

In pursuant to the order of interim protection, the petitioner has appeared before the I.O. and his statement has been recorded.

Considering the facts and circumstances, custodial detention is not considered necessary for interrogation. Hence, the prayer for pre-arrest bail is allowed.

Accordingly, interim order dated 17.09.2025 is hereby made absolute subject to the conditions mentioned in the said interim order at serial No. (b) and (c).
