Heard the learned counsel for the petitioner and the learned Addl. PP, Assam.

This is an application under Section 482 of BNSS for granting pre-arrest bail to the petitioner, namely, Mofidul Islam @ Mafidul Islam, in connection with Mukalmua P.S. Case No. 175/2025 under Sections 69/117(2)/296/ 351(2)/351(3)/108 BNS.

As per the allegations contained in the FIR, the victim, aged about 23 years, had been in love affair with the accused petitioner, who promised to marry her and entered into physical relationship with her. On 11.07.2025, the accused took the victim to his house and kept her there for the whole day and in the evening, the accused assaulted her saying that he will not marry her and brought her to Bhella road at Barpeta district and fled. She was brought home by her brother and on that night itself, the accused called her on her mobile phone using slang language and threatened that he will share the private photos and videos of the victim in social media and out of fear of humiliation in society, she committed suicide by hanging herself in her bedroom.

Learned counsel for the petitioner submits that the allegations as contained in the FIR are entirely false although it is admitted that the petitioner was in a love affair with the victim.

The learned Addl. PP, on the other hand, submits that there is sufficient incriminating material against the petitioner available in the case diary, which clearly points towards abatement of suicide by the petitioner.

Having regard to the above, the prayer for pre-arrest bail stands rejected.
