1. Heard Mr. S. Munir, learned counsel for the petitioner. Also heard Mr. D.P. Goswami, learned Additional Public Prosecutor for the State.

This is an application u/s 482 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 for granting pre-arrest bail to the accused petitioner, namely, Bikash Choudhury in connection with All Women Police Station Case No. 52/2025 u/s 69/351(2) of Bharatiya Nayaya Sanhita (BNS), 2023 read with Section 67/67 a/66 E/66 C of Information Technology Act, 2000 .

3. The gist of the allegations in the FIR lodged by the victim woman is that she came to know the accused herein through social media and their relationship developed, which also developed into a physical relationship.

4. It is also alleged that the accused had obtained some private photographs of the victim and threatened to upload the same in the internet. Subsequently, he also did the same. Under such threats, he had earlier also committed forceful relationship with her.

5. The case diary as called for has been received.

6. In her statement recorded before Magistrate as well as before the police, the alleged victim woman has reiterated these allegations about threatening and the viraling of her photographs. Though not admissible, but even in the statements of the accused and his wife, who is also a co-accused, such a thing emerges.

7. In the given facts and circumstances, this would not be a fit case to grant anticipatory bail as investigation is not yet completed. Accordingly, the prayer for anticipatory bail application stands rejected at this stage, thereby vacating the order of interim prearrest bail.
