Heard Mr. K. Mahmud, learned counsel for the petitioner. Also heard Mr. C. K. S. Baruah, learned Govt. Advocate for all the respondents.

The Child Development Project Officer, Matia Integrated Child Development, Matia, Goalpara issued an Advertisement dated 08.02.2019 inviting applications for rendering the voluntary service as Anganwadi Workers/ Helpers against various Anganwadi Centers for Matia Integrated Child Development Project under Social Welfare Department. The petitioner applied for No. 174 Bahati Char Bhatipara Centre and after the selection process, she was selected in the final selection list of Anganwadi Workers and Anganwadi Helpers. In the said final selection list, the name of the petitioner appeared at Sl. No.4 against 174 No. Bahati Char Bhatipara.

The said select list with regard to 174 No. Bahati Char Bhatipara was challenged by one Sahara Bhanu Begum by way of filing WP(C)/1353/2019 and this Court

by order dated 27.02.2019, passed an interim order directing that no appointment shall be made without leave of this Court in terms of the Advertisement dated 08.02.2019. The said Writ Petition No. WP(C)/1353/2019 was thereafter, dismissed for non-prosecution by order dated 08.03.2022.

Consequent there to, the Director, Women and Child Development Assam wrote to the Child Development Project Officer, Matia, ICDS Project Goalpara on 17^th of August, 2022 directing to comply with the Court’s order dated 08.03.2022 and to issue the letter of expression of interest to accept the voluntary service as Anganwadi Worker against the said Anganwadi Centre.

Grievance of the writ petitioner in this Writ petition is that despite her selection, she is yet to be given her appointment till date.

On 16.02.2024, this Court directed the learned Govt. Advocate to take instructions. Today, when the matter is called up, learned Govt. Advocate has produced a communication dated 27^th of February 2024, written by the Child Development Project Officer containing the para-wise instructions and in the said para-wise instructions, it is stated that the petitioner can be allowed to join her post as Anganwadi Worker at No. 174 Bahati Char Bhatipara Anganwadi Centre if there is no other legal issues.

Considering the communication dated 27^th of February, 2024 and also the fact that WP(C)/1353/2019 has already been dismissed by the order dated 08.03.2022, the respondents, particularly, the respondent No.4 is directed to

allow the petitioner to join as Anganwadi Worker of No. 174 Bahati Char Bhatipara Centre within a period of 3(three) weeks from the date of receipt of a copy of the order of this Court. The petitioner is also permitted to furnish a certified true copy of this order to the respondent No.4.

Writ petition is accordingly disposed of.
