Ms. L Wajeeda, the learned counsel appearing on behalf of the petitioners submits that the petitioners have already applied in terms of the scheme Mission Basundhara of the Government of Assam and as such, the instant writ petition which was based upon the application of Section 16 of the Assam Fixation Ceiling on Land Holding Act, 1956 has become infructuous.
Taking into account the above, this Court, therefore, closes the instant writ petition as infructuous.
It is made clear that the closing of the instant writ petition as infructuous would not in any manner prejudice the petitioners in their applications, so filed seeking allotment of land.
