“On 31.10.2013, Shri Subol Paul, respondent No.1, since deceased and represented by his wife Smt. Minu Paul, was travelling in a pick-up van, bearing Registration No.AS-09C-6169, from Bokajan towards Golaghat side and on reaching Garampani Reserve, the pick-up van by which Mr. Subol Paul was travelling, knocked down by an Oil Tanker, bearing Registration No.MN-01-6159, which was coming from opposite direction. In the said accident, Subol Paul sustained serious injuries and he was shifted to Golaghat Civil Hospital and from there to Assam Medical College, Dibrugarh. Thereafter, Subol Paul has instituted one Motor Accident Claim proceeding before the learned Member, MACT, Dimapur, claiming a compensation amounting Rs.14,84,000/- for the injuries sustained by him. Upon the said claim petition, the learned Member, MACT, Dimapur, issued summon to the present appellant and other respondents. The appellant entered appearance and contested the petition by filing written statement and denied its liability. Thereafter, hearing both the parties, the learned Tribunal was pleased to direct the appellant, vide impugned judgment and order dated 09.07.2020, to pay compensation amounting Rs.4,67,764/- in favour of the claimant and further directed to make payment of the said amount within a period of 1(one) month from the date of the order and in default to pay interest @9% per annum from the date of filing the claim petition.”
