Heard Mr. M.Sharma, learned counsel for the petitioner. Also heard Mr.D.Das, learned Additional Public Prosecutor, Assam appearing for the State respondent.
By this petition under Section 482 of the Cr.P.C. the petitioner has challenged the order dated 06.10.2023 passed by the learned JMFC, Kamrup(M), Guwahati in connection with Petition No.4138/2023 for zimma of Model Tata LPT1512 bearing Registration No.AS01NC-4196 to the petitioner ( Khetri P.S. Case No.37/2023).
A report has been submitted by the learned Addl.P.P. received from the I.O. of Khetri Police Station wherein it reflects that the trial court has already handed over the zimma of the vehicle to its registered owner. However, the owner of the vehicle did not take away the vehicle and since then the vehicle is lying in front of the Police station gate.
In view of the above, the petitioner is directed to approach the learned trial court within 10 days from today and learned trial court will dispose of the matter in accordance with law.
The criminal petition stands disposed of accordingly.
