This appeal was preferred against an order dated 01.12.2021 passed by the learned Special Judge Court, NIA Assam, Guwahati in NIA Misc Case No. 23/2021 under Section 120B of Indian Penal Code, R/w Section 18/38 of the Unlawful Activities (Prevention) Act, 1967 whereby the prayer for bail was rejected.
The learned counsel for the appellant has however submitted that there has been subsequent development for which there is no requirement to press the appeal.
Shri Dev Choudhury, the learned Standing Counsel submits that he will not have any objection if the appeal is allowed to be withdrawn.
In view of the above, the appeal is dismissed on withdrawal.
