Phukan, learned counsel for the petitioner, that during the pendency of the present criminal appeal and the interlocutory application, the warrant has already been executed and the appellant/applicant has already been served out his remaining sentence of 26 days and also paid the fine and thus, the present criminal appeal, along with the interlocutory application, has become infructuous and the appellant/applicant does not want

to press the same and accordingly prays for disposal of the same.
