Heard Ms. T Som, the learned counsel appearing on behalf of the petitioners.

This contempt petition has been filed seeking initiation of contempt against the respondent herein for willful and deliberate violation of the order dated 27.02.2023 passed in WP(C)No.6314/2022. It is seen that there was a direction to the petitioners to submit a representation to the respondent No.3 i.e. the Deputy Director, Food, Civil Supplies and Consumer Affairs, Barpeta in the said proceedings and the respondent No.3 was directed to dispose of the representation within three weeks therefrom.

It is further seen that a document has been enclosed as Annexure-B to the contempt petition, however, in the said document, there is nothing to show as to when the said representation had been submitted before the Deputy Director Food, Civil Supplies and Consumer Affairs, Barpeta. Under such circumstances, this Court is of the opinion that the initiation of the instant contempt proceedings would not be proper at this stage, for which, the contempt petition stands dropped.

However, liberty is given to the petitioner to submit a representation in terms with the order dated 27.02.2023 passed in WP(C)No.6314/2022 to the present incumbent in the Office of the Deputy Director Food, Civil Supplies and Consumer Affairs, Barpeta. It is further observed that in the circumstance, the

petitioner submits the representation as directed by this Court before the present Deputy Director Food, Civil Supplies and Consumer Affairs, Barpeta, the said authority shall duly pass appropriate order(s) in terms with the order dated 27.02.2023 passed in WP(C)No.6314/2022.
