Mrs. S. Borpatra Gohain, learned counsel for the applicant prays that the applicant may be allowed to receive Cheque No. 285642 amounting to Rs. 1,48,85,761/-, in view of the order dated 06.03.2024 passed in Cont.Cas(C) 611/2016.

Mr. B. Gogoi, learned counsel for the Health Department submits that he has got no objection to the application being allowed, provided the applicant/writ petitioner provides proper identification. He further submits that an amount of Rs. 16,53,974/- has been deposited by way of a challan with the Income Tax Authorities, which pertains to the TDS payable from the principal amount to be paid to the petitioner.

In view of the consent of the parties and keeping in view the order dated 02.11.2015 passed in WP(C) 1034/2018 and the order dated 06.03.2024 passed in Cont.Cas(C) 611/2016, the Registry is directed to release to the applicant Cheque No. 285642 amounting to Rs. 1,48,85,761/-, on proper identification.

The copy of the challan is made a part of the record and marked as Annexure “X”.
