Heard Mr. T. Deuri, learned counsel for the applicants. Also heard Mr. G. Imtiaz, learned counsel for the respondent Nos. 3(i) to 3(iii).

This application under Order XXII Rule 3 read with Section 151 of the Code of Civil Procedure, 1908 has been filed by the applicants for substituting the legal heirs of late Hemendra Nath Deka i.e., the respondent No. 1, who had expired on 17.11.2023.

The learned counsel for the respondent has not opposed the prayer for

substitution.

Considering the grounds mentioned in the substitution application as well as submissions made by the learned counsel for the parties, the prayer for substitution is allowed.

Let the legal heirs of late Hemendra Nath Deka, namely, Nepolin Deka and Marvelin Deka be substituted as respondent Nos. 1(a) and 1(b) in place of respondent No. 1 in the memo of appeal.

Registry is directed to substitute the names of aforementioned legal heirs in pursuant to this order in the memo of appeal within a period of one week from the date of this order and list the RSA again before this Court.

This substitution application is hereby disposed of.
