This is an application filed under Section 439 Cr.P.C. praying for

granting regular bail to the petitioners, 1. Sajeda Begum and 2. Rohim Ali, who were arrested on 16.02.2024 in connection with Hatigaon PS Case No. 262/2023 under Section 406/370/34 IPC.

The learned counsel for the petitioner submits that the accused/ petitioners are innocent and they have been falsely implicated the case. Investigation is almost over and the accused has thoroughly been interrogated by the Investigating Agency. Further the petitioners are under detention for last 54 days.

Considering the period of detention and stage of investigation, this Court is of the opinion that no further custodial detention of the petitioner is required. Accordingly, the present application is allowed.

It is directed that the applicants be released on bail on their furnishing a personal bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each with one solvent surety in the like amount to the satisfaction of the learned CJM, Kamrup (M) with the following conditions.

(1) The petitioners shall not hamper with the investigation, or tamper with the evidence of the case,

¶20

(2) The petitioners shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or to any police officer,

¶21

(3) The petitioners shall appear before the I/O on each and every date as and when called for.
