From the order dated 20.09.2023 it appears that the counsel representing the petitioner in this case had withdrawn from the matter and accordingly, their names were struck off from the Cause List. This Court had earlier directed the Registry to issue notice to the petitioner informing him about the withdrawal of his counsel. Office note dated 04.01.2024 goes to show that the notice was duly issued to the petitioner but the same has returned unserved with an endorsement in the envelope as “Addressee Moved, RTS”.

Today when the matter is called up, no other counsel has appeared for the petitioner. Under the circumstances, unless the petitioner himself takes initiative to pursue the matter, this proceeding cannot be continued any further in this Court.

Therefore, by granting liberty to the petitioner to seek revival of this Arbitration Petition by furnishing sufficient justification as and when the occasion arises, this Arbitration Petition stands dismissed for non-prosecution.
