Heard Ms. S. G. Baruah, learned counsel for the petitioner. Also heard Mr. K. Baishya, learned Additional Public Prosecutor for the State.

The learned counsel for the petitioner has submitted that by order dated 17.05.2024, the petitioner, namely, Rajjak Ali was allowed to go on interim bail by this

Court and in pursuant to the directions of this Court, the petitioner has appeared before the Police on more than one occasion.

On the other hand, learned Additional Public Prosecutor submits that though the case diary of North Lakhimpur P.S. Case No. 56/2024 is available, however, there is no endorsement in the case diary showing that the petitioner had appeared before the Investigating Officer.

The learned Additional Public Prosecutor also submits that in the case diary nothing incriminating has been found against the present petitioner, however, there is an endorsement against one Abdul Rajjak, S/o- Gazibur Rahman in the case diary.

¶17

Considering the submissions made by the learned counsel for the parties as well as materials available in the case diary, the interim bail granted to the above named petitioner by order dated 17.05.2024 is hereby made absolute with condition No. 2 attached to the said order remaining intact.

This anticipatory bail application is hereby disposed of.
