Heard Mr. N. Nath, learned counsel for the petitioner and Mr. R. R. Gogoi, learned Standing Counsel, AAU, for the respondent Nos. 1 to 4.
Mr. Nath, learned counsel for the petitioner placed before the Court that during pendency of this writ petition; the Dean, Faculty of Veterinary Science, Assam Agricultural University, Khanapara, Guwahati issued a Notification on 13.02.2023 inviting applications from Professors for the post of Head of various departments of the Faculty of Veterinary Science at Assam Agricultural University, Khanapara, Guwahati and for that he has filed the connected Interlocutory Application stating the changed circumstances and for necessary amendment of the present writ petition, including the prayer because of said changed circumstances, that arose after filing of this writ petition.
During the deliberation of the matter, Mr. Nath, learned counsel on instruction of the petitioner, prays for withdrawal of this writ petition, with a liberty to file afresh bringing in all the relevant facts placed in this writ petition along with the change circumstances in terms of the Notification issued on 13.02.2023 by the Dean, Faculty of Veterinary Science, Assam Agricultural University, Khanapara, to which learned counsel for the respondents in the Agricultural Department on instruction have no objection.
Prayer is allowed.
Accordingly, this writ petition, on being withdrawal, stands dismissed.
Liberty as prayed for, so granted.
