Mr. R. Mazumdar, learned counsel for the petitioner submits that in view of the determination made by the Hon’ble Apex Court in the case of Union of India –Vs- Probir Ghosh and Ors, Civil Appeal No. 4585/2018, wherein similar claim as that of the petitioner has been negated, nothing survives to be adjudicated in the present writ petition.
In view of the aforesaid submissions, the present writ petition stands closed being infructuous.
