Heard Mr. A. R. Bhuyan, the learned counsel for the petitioner and Ms. D. Borah, the learned counsel appearing on behalf of the Health Department, Assam.
The learned counsel for the petitioner has submitted that as in pursuance to the communication dated 18.02.2023, there has been no representation submitted to the concerned Minister or the Appointing Authority, he would not like to press the instant writ petition, however, the withdrawal of the instant writ petition should not preclude the right of the petitioner to submit the representation to the authorities concerned.
Taking into account the same, the instant writ petition stands

dismissed on withdrawal. However, the dismissal of the writ petition shall not prejudice the right of the petitioner to approach the authority concerned.
