This writ petition has been filed, seeking a direction to the respondent to dispose of the complaint dated 18.03.2021, lodged by the petitioner before the Chief Secretary, Government of Arunachal Pradesh, Itanagar and also to stay/suspend the release of contractual payment arising out of re-tender, dated 28.08.2020 and supply orders being No. COVID-19/MDEV-43/2020-2, dated 13.10.2020 & 02.12.2020, issued by the Secretary, Health & Family Welfare, Itanagar and Director of Health Services, Naharlagun, respectively.

The complaint dated 18.03.2021, submitted by the petitioner before the Chief Secretary, Government of Arunachal Pradesh, Itanagar, is for not releasing any contractual payment against COVID-19/MDEV-43/2020-2, supply orders awarded by the Secretary, Health & Family Welfare, Itanagar & Director of Health Services, Naharlagun, dated 13.10.2020, 02.12.2020 & 17.12.2020.

Counter-affidavit by the respondent nos. 2 & 3 have been filed, whereby, it has been stated that the representation, dated 18.03.2021, submitted by the petitioner to the Chief Secretary, Government of Arunachal Pradesh, has been considered and disposed of by an order dated 16.07.2021, passed by the Secretary, Health & Family Welfare, Itanagar and Director of Health Services, Government of Arunachal Pradesh, Itanagar, vide Memo No. Med/HCC-04/2021 (Annexure-2 to the counter-affidavit filed by the respondent).

Since the prayer of the petitioner to dispose of the representation dated 18.03.2021 and not to release payment for the work mentioned in the representation, dated 18.03.2021, have been considered and disposed of by

the respondent authority, vide order dated 16.07.2021, referred to hereinabove, this writ petition has become infructuous and accordingly, it is disposed of as infructuous, with a liberty granted to the petitioner to challenge the order dated 16.07.2021, passed by the Secretary, Health & Family Welfare, Itanagar and Director of Health Services, Government of Arunachal Pradesh, Itanagar, vide Memo No. Med/HCC-04/2021, if so advised.
