Heard Mr. S. Biswas, learned counsel for the petitioner and Mr. B. Taipodia, learned counsel appearing on behalf of Mr. R. Saikia, learned Standing Counsel for the Arunachal Pradesh Information Commission(APIC).

This is an application filed by the applicant seeking recall of the order dated 16.02.2023, passed in WP(C)369(AP)2020, whereby the WP(C)369(AP)2020 was dismissed for default and for non-prosecution, amongst other, on the ground that fresh steps for service of notice upon respondent No.5 was not taken, despite the order dated 26.10.2022.

Having heard the learned counsels for the parties, this application is allowed and the order dated 16.02.2023 passed in WP(C)369(AP)2020 is hereby recalled and the writ petition is restored to file on the condition that steps for service of notice upon respondent No.5 be taken by registered post with A/d as well as by usual process, within 3(three) days, failing which, the WP(C)369(AP)2020 shall again stand dismissed for default, without further reference of this Court.
